Terms and Conditions

​​Fees

Event type and hours booked will determine fee. The Face Paint Lady's fees start at $100 per hour with a 1-hour minimum, payable upon time of service.

 

Payments can be made by cash, business check, credit card or by using venmo, paypal, or cashapp.

​

Returned checks will result in a check fee of $30; in such case the updated final payment will only be accepted by cash or credit card. Payment in full must be made within 48 hours of notification of a returned check.

 

Overtime

Overtime may be requested by client and will be billed at the same hourly rate listed in the agreement. Overtime is pending performer's availability.

 

Retainer

The $50 booking retainer is not refundable if event is cancelled by client.

Travel Fees

Travel fees apply when the event is more than 10 miles from zip code 13212.

 

Parking

Client will provide adequate parking and will reimburse The Face Paint Lady staff for any parking fees.

 

SETUP

Indoor Setup

Bathroom facilities and a minimum of 6'x6' of cleared space is required. Adequate lighting is necessary.

Outdoor setup (options)

You provide us with sun/rain/wind shelter, adequate space and lighting to perform.

We can bring EZ-up shelter, tables and chairs for additional set up fee of $35. We will need 25 minutes of set up/tear down time in this case, and require a minimum of 10' x 10' level space, access to a restroom, and adequate lighting to perform.

Outdoor setup (Characters)

Because of the delicacy of our wigs and costumes, and for our performer's safety and comfort, the ground must be dry and shade must be provided to our performers at all times.

 

Breaks and Stop Time

Performers will have breaks of 5-10 minutes every two hours and access to a restroom.

 

If you have booked by the hour, it is your responsibility to limit additional guests from requesting services after stop time. Please book enough time to allow all your guests to participate to avoid disappointment.

Cancellations/Refunds/Rescheduling

Should you need to reschedule, please do so 7-14 days prior to your event and we will make every effort to meet your needs.

Client can reschedule the same event no more than two times.

If you need to cancel the event, you must cancel within 7-14 days of the scheduled event or you will have to pay the following cancellation fees:

Events cancelled 7 days or less from the event date must pay the TOTAL contracted amount due to consequential loss of income from your date being reserved.

Events cancelled 8-14 days from the event date must pay 50% of the contracted amount due to consequential loss of income from your date being reserved.

In the event of non-payment, Client assumes full responsibility for any legal, court, and clerk fees incurred by FPL to recover payments.

Weather

Client is responsible for providing an alternate indoor or covered location in the event of rain or temperatures below 60 degrees or above 92 degrees. Client agrees to pay full amount contracted, even if it is raining. We do not offer refunds for inclement weather.

FACE PAINTING

Timing

The Face Paint Lady staff can paint approximately 12 - 15 faces per hour depending on intricacy of designs chosen. To save time, client may request “fast faces” only. Be sure to book your time accordingly to avoid leaving anyone out.

Artwork Limitations

If in public, artist will NOT paint any part of the body that is not legal to expose, or any place she does not feel comfortable painting. Artist will not paint any subject matter she deems offensive, disturbing, or inappropriate for the type of event.

Safety

The Face Paint Lady staff only uses cosmetic grade face painting supplies that are current with FDA requirements for use on skin, and are not liable for allergic reactions. People with skin allergies or very sensitive skin should either not participate, or ask the artist to perform a patch test at the beginning of the event.

For safety reasons, artist will not paint anyone who is unwilling to be painted, or anyone who seems scared, uncomfortable or unable to sit still.

For sanitary reasons, The Face Paint Lady staff will not paint anyone who is or appears to be sick (cough, runny nose, fever) or suffering from cold sores, conjunctivitis, ringworm, sunburn, eczema, any infectious skin condition, or open wounds.

​

BALLOONS

Balloons are a choking hazard and are not recommended for children under three. Supervision is recommended for all ages. 

Balloons cannot be twisted in temperatures lower than 60 degrees.

Extreme Adverse Working Conditions

The Face Paint Lady staff staff has the right to cease painting and leave without refunding any monies if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to their attention. Adverse conditions include but are not limited to destructive, violent, or extreme inappropriate behavior of a child, adult or pet, illegal activities or other dangerous situations.

Guests and Children

Under no circumstances will The Face Paint Lady staff supervise children. Their behavior and safety is the client and/or parent's responsibility.

Liability Statement

Limitation of Liability

Client acknowledges that there are risks and dangers inherent with the contracted-for entertainment, and with the props and products necessary for that entertainment. Client assumes the liability for all such risks and agrees to indemnify, defend and hold harmless FPL and all FPL artists from and against any and all accidents, claims, judgments, costs or liability for damage, injury to any person or property during the Event, including time of set up and take down, by guests or staff. Liability of FPL shall not exceed the total value of this Agreement.

FPL Quality of Service

FPL warrants that its Entertainers/Artists will perform all services in a professional manner consistent with the standards of their industries.

​

Force Majeure

Neither FPL nor Client will incur liability to each other for failing to perform any obligation under this Agreement if such failure results from a force majeure or any force beyond their reasonable control.

​

This Agreement shall be governed by, venued in, and construed in accordance with the laws of the State of NY. This Agreement constitutes the entire agreement between the FPL and Client and supersedes any prior written or oral communications. If any portion of this Agreement is deemed invalid, the remainder of the Agreement will remain in full force and effect.
